General Accountability 

Reporting to the Head, Renewable Energy Programs, the Manager, Commercial Management is responsible for providing guidance and operational management of commercial decision-making and promotion of coordination of commercial management issues for the Innovation & Sustainability Group (ISG). This role will provide commercial management services and advice to the Head, Renewable Energy Programs and other TTC senior leaders as it relates to the ISG’s commercial management matters. 

This role will manage the lifecycle of commercial management - from inception and development through to implementation – for ISG’s projects and initiatives that vary in complexity. They will lead these initiatives with a focus on commercial management leading practices, data-driven decisions and operational performance measures. 

Key Job Functions 

  • Responsible for the development and implementation of comprehensive strategies, methodologies, tools, and techniques for commercial management excellence and continuous improvement. 

  • Facilitates the development and implementation of commercial management systems, standards, and operational procedures in accordance with corporate standards and practices to ensure fulfillment of strategic and value-for-money objectives of ISG’s large and complex operational initiatives. 

  • Works with Procurement & Category Management to implement the commercial aspects of recommended procurement strategies that are consistent with overall strategic goals of ISG and the TTC. 

  • Provides guidance and leadership in the development of contract negotiation, commercial governance and management strategies to ensure that ISG effectively negotiates contracts that adhere to TTC’s corporate policies and procedures, and to minimize corporate liability and risk throughout the contract lifecycle. 

  • Implements and monitors claims prevention strategies, plans and actions to protect the TTC’s best interests and reputation.

  • Monitors status of Key Performance Indicators (KPIs), on a monthly basis, and leads a team to develop and update reporting for material projects and contracts. 

  • Interacts with senior staff from internal and external stakeholders with respect to claims, dispute resolution, etc. including Procurement & Category Management, Finance, Legal, external claims and legal consultants, contractors, and consultants. Ensures contractor adherence to terms, conditions and other contractual obligations by engaging and supporting internal and external legal representation in negotiations and resolution of matters, enforcement of Liquidated Damages, other contractual remedies, etc. 

  • Provides subject matter expertise in the area of complex projects, focusing on the areas of risk, quality, safety and security, and the application of regulatory requirements. 

  • Manages the provision of commercial management expertise and advice to ISG’s project teams regarding all aspects of contract administration and risks through the lifecycles of large-scale, concurrent operational projects. 

  • Addresses significant commercial issues, including complex engineering and operational challenges to ensure the completion of key projects and strategies; Facilitates collaboration and cooperation between stakeholders and external contractors to ensure project delivery and issues resolution of commercial matters. 

  • Responsible for treating passengers and/or employees with respect and dignity and ensuring the needs of passengers or employees with disabilities are accommodated and/or addressed (if applicable and within their area of responsibility) in accordance with the Ontario Human Rights Code and Related Orders so that they can fully benefit from the TTC as a service-provider and an employer.

 Education and Experience 

  • A University Degree, or College Diploma in a related discipline (i.e., Civil Engineering, Contract/Construction Law, Business Administration, etc.) or a combination of education, training, and experience deemed to be equivalent. 

  • Certified Construction Contract Administrator (CCCA), Project Management Professional (PMP), Professional Engineer Ontario (P.Eng.), Certified Engineering Technologist (C.E.T.), or similar designation is considered as an asset. 

Additional Requirements 

  • Expert knowledge of construction contract administration and claims management techniques and practices in a large multi project complex construction and infrastructure environment. 

  • Demonstrated skills in the development, application and communication of internal contract administration procedures and leading practices, preferably in the transit and/or infrastructure industries. 

  • Extensive experience in the interpretation of contract law, and Ontario legislation (e.g. Construction Act, Professional Engineers Act, Canadian Construction Documents Committee documents, bespoke contract documents, specifications and drawings, and legal statutes and proceedings). 

  • Good knowledge of Human Resources legislation (e.g. Employment Standards Act, Occupational Health & Safety Act, etc.) to monitor and manage employees and contractors, including experience in the application of collective agreement provisions.

  • Sound understanding of quality assurance and quality control principles, practices and methods to lead the implementation of controls for contract management processes. 

  • Sound management and motivation skills to manage departmental staff and lead projects and motivate a team of commercial management professionals. 

  • Solid negotiation and oral/written/presentation skills to deal with all contract administration and commercial management issues and to lead claims negotiations with contractors. 

  • Sound interpersonal and oral/written/presentation skills to present complex and/or new ideas with clarity and simplicity, liaise with all levels within the organization and in the field, and work effectively with specialists across multiple sectors. 

  • Knowledge of risk management systems and processes to identify and mitigate risk; Recognized organizational and research skills to conduct research into current trends, leading practices, tools and technologies. 

  • Proficiency in MS Office (Excel, Word, Visio) with an understanding of database management systems. 

  • Must have or rapidly acquire a comprehensive knowledge of the Ontario Human Rights Code and Related Orders including disability accommodation and accessibility requirements pertaining to passengers and employees. 

  • Ability to interpret/apply legislation and technical information to the TTC’s electrification infrastructure and facilities. 

  • Must obtain WHMIS certification and OHSA training.
